LIABILITY WAIVER AND RELEASE

  1. By proceeding with this booking, I WAIVE AND RELEASE, indemnify, hold harmless and forever discharge Solstice KI, and its agents, employees, officers, directors, affiliates, successors and assigns, coaches, teachers and trustees of and from any and all claims, demands, debts, contracts, expenses, cause of action, lawsuits, damages, and liabilities, of every kind of nature, whether known or unknown, in law or equity, that I ever had or may have, arising from or in any way related to my participation in any of the events or activities conducted by, or in connection with Solstice KI, on the premises, of, or for the benefit of, Solstice KI, provided that this waive of liability does not apply to any acts of gross negligence, or intentional, willful or wanton misconduct.

  2. I understand that the activities, in which I will participate, are inherently dangerous and may cause serious or grievous injuries, including bodily injury, damage to personal property and/or death. On behalf of myself, my heirs, assigns, administrators, executors and next of kin, by proceeding with my booking, I agree to waive all claims of damage, injuries and death sustained to me or my property, that I may have against the aforementioned release party to such activities, including claims in tort, contract, equity or otherwise.

  3. I acknowledge, agree and represent that by proceeding with this booking I understand the nature of the activities provided at Solstice KI, I AM IN GOOD HEALTH and in PROPER PHYSICAL CONDITION to participate in such activities. I further agree and warrant that if at any time I believe conditions to be unsafe, I will IMMEDIATELY DISCONTINUE further participation in the activity and notify staff at Solstice KI.

  4. By proceeding with this booking, I assume any risk, and take full responsibility and waive and of personal injury; death, damage, or loss of personal property, associated with Solstice KI, including but not limited to Vehicles on site, encounters with animals, movement around designated areas.

  5. This WAIVER AND RELEASE contain the entire agreement between parties, and supersedes any prior written or oral agreements between them concerning the subject matter of this WAIVER AND RELEASE. The provisions of this WAIVER AND RELEASE may be waived, altered, amended or repealed, in whole or in part, only upon the prior written consent of all parties.

  6. The provision of this WAIVER AND RELEASE will continue in full force and effect even after the termination of the activities conducted by, on the premises of, or for the benefit of Solstice KI, whether by agreement, by operation of law, or otherwise.

  7. I have read, understood and fully agree to the term of this WAIVER AND RELEASE. By proceeding with this booking, I acknowledge, understand and confirm that I have given up considerable future legal rights

  8. By proceeding with the booking, I confirm that I am agreeing to this WAIVER AND RELEASE freely, voluntarily, under no duress or threat of duress, without inducement, promise or guarantee being communicated me. My electronic agreement to this WAIVER AND RELEASE is shown by proceeding with this booking and is proof of my intention to execute a complete and unconditional WAIVER AND RELEASE of all liability to the full extent of the law.

CANCELLATION POLICY

Cancellations must be made via e-mail to hello@solsticekangarooisland.com.au at least 48 hours before the scheduled visit for a full refund.

No refunds for cancellations made less than 48 hours before the scheduled visit.

Rescheduling is allowed, subject to availability, with no extra charge if requested 48 Hours in advance (excluding third party fees).

In the event of unforeseen circumstances (eg. weather) we reserve the right to reschedule or cancel with a full refund (excluding third party fees).

PRIVACY POLICY

This Privacy Policy applies to all personal information collected by Solstice KI via the website located at www.solsticekangarooisland.com.au.

  1. What is "personal information"?

    1. (a)  The Privacy Act 1988 (Cth) currently defines "personal information" as meaning information or an opinion about an identified individual or an individual who is reasonably identifiable:

      1. (i)  whether the information or opinion is true or not; and

      2. (ii)  whether the information or opinion is recorded in a material form or not.

    2. (b)  If the information does not disclose your identity or enable your identity to be ascertained, it will in most cases not be classified as "personal information" and will not be subject to this privacy policy.

  2. What information do we collect?

    The kind of personal information that we collect from you will depend on how you use the website. The personal information which we collect and hold about you may include: Personal information generally refers to information that can be directly used to personally identify the individual. Examples include and are not limited to login credentials payment details email address name phone number address.

  3. How we collect your personal information

    1. (a)  We may collect personal information from you whenever you input such information into the website.

    2. (b)  We also collect cookies from your computer which enable us to tell when you use the website and also to help customise your website experience. As a general rule, however, it is not possible to identify you personally from our use of cookies.

  4. Purpose of collection

    1. (a)  The purpose for which we collect personal information is to provide you with the best service experience possible on the website.

    2. (b)  We customarily disclose personal information only to our service providers who assist us in operating the website. Your personal information may also be exposed from time to time to maintenance and support personnel acting in the normal course of their duties.

    3. (c)  By using our website, you consent to the receipt of direct marketing material. We will only use your personal information for this purpose if we have collected such information direct from you, and if it is material of a type which you would reasonably expect to receive from us. We do not use sensitive personal information in direct marketing activity. Our direct marketing material will include a simple means by which you can request not to receive further communications of this nature

1. Australian Privacy Principle 12 permits you to obtain access to the personal information we hold about you in certain circumstances, and Australian Privacy Principle 13 allows you to correct inaccurate personal information subject to certain exceptions. If you would like to obtain such access, please contact us as set out below.

6. Complaint procedure

  1. If you have a complaint concerning the manner in which we maintain the privacy of your personal information, please contact us as set out below. All complaints will be considered by Geoffrey or Elena Allen and we may seek further information from you to clarify your concerns. If we agree that your complaint is well founded, we will, in consultation with you, take appropriate steps to rectify the problem. If you remain dissatisfied with the outcome, you may refer the matter to the Office of the Australian Information Commissioner.

7. Overseas transfer

  1. Your personal information will not be disclosed to recipients outside Australia unless you expressly request us to do so. If you request us to transfer your personal information to an overseas recipient, the overseas recipient will not be required to comply with the Australian Privacy Principles and we will not be liable for any mishandling of your information in such circumstances.

8. GDPR

  1. In some circumstances, the European Union General Data Protection Regulation (GDPR) provides additional protection to individuals located in Europe. The fact that you may be located in Europe does not, however, on its own entitle you to protection under the GDPR. Our website does not specifically target customers located in the European Union and we do not monitor the behaviour of individuals in the European Union, and accordingly the GDPR does not apply.
